Terms of Service — Nacionaliza

These Terms of Service ("Terms") govern your use of Nacionaliza ("the app"), operated by Kelly Zwart ("we", "us").
By using the app you agree to these Terms. If you don't agree, don't use the app.
1. The product
Nacionaliza is a study tool designed to help you prepare for the Spanish nationality exams CCSE (Conocimientos Constitucionales y Socioculturales de España) and DELE A2. It is not an official Instituto Cervantes, Ministerio de Justicia, or Spanish government product. We are not affiliated with the Instituto Cervantes or any official Spanish nationality body.
The exam content used in the app is original material we created to mimic the structure and difficulty of the real exam. We make no guarantee that practicing with our app will make you pass the actual exam — it is a study aid, not a guarantee.
2. Account and access
- Free tier: no account needed. You can use the app immediately with the included free content.
- Paid tier: you provide an email address when you purchase. Your purchase is tied to that email.
- We may verify your entitlement on each app launch. If validation fails, you may temporarily be downgraded to free until validation succeeds.
3. Payments and refunds
Web purchases (via Stripe)
- 3-month pass: €19,99 one-time payment, access for 90 days from purchase.
- Lifetime access: €49,99 one-time payment, no expiry.
- All prices include VAT where applicable. Stripe handles tax calculation.
- EU consumer right of withdrawal (14 days): You may request a refund within 14 days of purchase, but only if you have not used the paid content. By purchasing and immediately accessing paid content you waive this right per EU Directive 2011/83/EU Article 16(m). This is explicitly confirmed at checkout.
- After 14 days, no refunds.
- For accidental duplicate purchases, contact us within 7 days for a refund.
Mobile purchases (Apple / Google)
- Refunds for iOS purchases are handled by Apple. Refunds for Android purchases are handled by Google. Use their respective support channels.
Subscription renewal
- The 3-month pass is a one-time payment, not a subscription. It does not auto-renew.
- The lifetime tier is one-time and does not recur.
4. Trial period
A 7-day free trial is available. After the trial:
- Your access reverts to the free tier automatically.
- No payment is taken during the trial.
- You may purchase a paid plan at any time during or after the trial.
5. Acceptable use
You agree NOT to:
- Reverse-engineer, decompile, or attempt to extract our content (the texts, questions, and answers are our intellectual property).
- Redistribute, resell, or sublicense our content.
- Use the app to harm or defraud others.
- Use the app for any unlawful purpose.
6. Intellectual property
- All training content (aanvulzinnen, vraag-antwoord items, reading texts, MC questions and answers) is original work by us, copyrighted to Kelly Zwart.
- The app's source code is proprietary.
- The app's name "Nacionaliza", logo, and design are ours.
- You receive a limited, non-transferable license to use the content for personal study only.
7. Third-party services
The app uses:
- Stripe for web payments.
- Apple App Store / Google Play Store for mobile distribution and payments.
- Anthropic Claude API for AI answer grading.
- Vercel for web hosting.
Your use of these services is also governed by their terms.
8. Disclaimers
The app is provided "as is" without warranty of any kind. Specifically:
- We do not guarantee uninterrupted availability.
- We do not guarantee that practicing with the app will result in passing your real exam.
- We do not guarantee that AI grading is perfectly accurate (it's a helpful approximation, not a substitute for human teachers).
- Exam content, format, and pass thresholds at DUO/Cito may change — we update the app when we learn of changes but cannot guarantee real-time synchronization.
9. Limitation of liability
To the maximum extent permitted by Dutch law:
- Our total liability for any claim is limited to the amount you paid us in the past 12 months.
- We are not liable for indirect, incidental, or consequential damages (e.g., missing your exam, lost time).
- We are not liable for exam results or visa/MVV application outcomes.
10. Termination
- You may stop using the app at any time. Delete it from your device and any data wipes.
- We may terminate your access if you violate these Terms (e.g., reverse-engineer the content).
- If we close the service, paid users will receive a pro-rated refund for unused time on a 3-month pass; lifetime users will receive a refund of their purchase price.
11. Changes to these terms
We may update these Terms. Material changes will be notified in-app. Continued use after the update means you accept the new Terms.
12. Governing law and disputes
These Terms are governed by Dutch law. Any dispute will be resolved by the courts of the Netherlands. Nothing in these Terms reduces your statutory consumer protections under EU law.
